These Terms of Use ("Terms") govern your access to and use of Daydrop, including the mobile apps and the website (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Who we are

Daydrop is a personal journaling app for capturing daily moments through text, photos, voice recordings, and videos. Daydrop is a brand of connvision Ltd., which operates the Service (see the Privacy Policy for controller details).

2. Eligibility

You may use Daydrop only if you are legally capable of entering into a binding agreement with us under applicable law. If you are under the minimum age required in your country, you may only use the Service with the consent of a parent or guardian.

3. Your account

You are responsible for maintaining the confidentiality of your account and authentication credentials (for example, your device passcode, sign-in with Apple, or Google login). You are responsible for all activities that occur under your account.

You must provide accurate information and keep it up to date. You must promptly notify us if you believe your account has been compromised.

4. Your content

You retain all rights to the journal entries, photos, videos, audio recordings, and other content you upload to Daydrop ("User Content").

To operate and improve the Service, you grant us a worldwide, non-exclusive, revocable, royalty-free license to store, process, and display your User Content solely for the purposes of:

  • providing core features such as capture, search, timeline, and sync,
  • generating derived data such as transcripts, tags, summaries, and visual analysis via our AI and third-party providers (for example, OpenAI),
  • maintaining backups, security, and reliability of the Service, and
  • complying with legal obligations.

We do not claim ownership of your User Content, and we do not sell your personal journal content to third parties.

5. Acceptable use

You agree not to use the Service to:

  • violate any applicable laws or third-party rights,
  • upload unlawful, harmful, or abusive content,
  • attempt to reverse engineer, interfere with, or disrupt the Service, underlying infrastructure, or security features,
  • use automated systems (such as bots or scrapers) to access the Service in a way that may impair performance or security, or
  • create accounts or content for the purpose of fraud, abuse, or misleading others.

6. Third-party services

Daydrop integrates with third-party services such as Google Firebase, OpenAI, Google Maps, OpenWeather, Supabase, and authentication providers like Google and Apple. On the website we may also use analytics and advertising measurement tools such as Google Analytics, Meta (Facebook/Instagram) Pixel, and TikTok Pixel to understand how people discover Daydrop and how our campaigns perform. Your use of those services may be subject to their own terms and privacy policies. We describe how they process personal data in our Privacy Policy.

7. Advertising

We do not show third‑party advertisements inside the Daydrop app or on the public website. We may, however, run campaigns on platforms such as TikTok, Instagram, and Google, and use their analytics and measurement tools to understand how people discover Daydrop and to improve those campaigns.

8. Intellectual property

The Daydrop name, logo, design, and all related trademarks and content (excluding your User Content) are owned by us or our licensors and are protected by applicable intellectual property laws. You may not use our branding or materials in a way that could cause confusion or imply endorsement without our prior written permission.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Service.

We implement reasonable technical and organizational measures to protect your data, but no online service can guarantee absolute security. To the extent permitted by applicable law, we are not liable for unauthorized access, data breaches, or other security incidents caused by third parties or events outside our reasonable control.

10. Termination

You may stop using Daydrop at any time and may delete your account within the app where that option is provided. We may suspend or terminate your access to the Service if you materially breach these Terms, misuse the Service, or where required by law.

11. Governing law

These Terms are governed by the laws of Switzerland, without regard to conflict of laws principles, except where mandatory consumer protection rules in your country of residence provide otherwise. Any disputes will be subject to the non-exclusive jurisdiction of the competent courts in Zürich, Switzerland.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, notify you within the app or by email. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
